Lincoln's Birthday Presentation Thursday, March 19 2009
Jeff Hawkins presented a program to Sullivan High School juniors and seniors about why it was important that President Lincoln was a lawyer. Students raised very thoughtful questions and contributed in the discussion very intelligently.

Hawkins Teaches Legal Ethics Friday, October 10 2008
Jeff Hawkins presented ethics principals for lawyers to plan practice management in the event of their death or disability at the Indiana Continuing Legal Education Forum's 2009 Elder Law Institute on October 10, 2008.

Hawkins Tapped to Chair ISBA House of Delegates Friday, October 10 2008
The Indiana State Bar Association's (ISBA) House of Delegates elected Jeff Hawkins to its Chair-Elect post at its 2008 Annual Meeting in Indianapolis on October 3, 2008. The House of Delegates is the policy making body of the ISBA composed of attorney delegates from each Indiana county. In addition to overseeing the internal affairs of the ISBA, the House considers legislative and administrative law proposals and its members debate whether to submit those proposals to Indiana goverment for adoption. Hawkins will assume the chairmanship at the end of the House's 2009 meeting in Indianapolis in November 2009.

Hawkins Teaches Guardianship Law Friday, October 10 2008
Jeff Hawkins taught a course on guardianship law to attorneys preparing for the 2009 Estate Planning and Administration Specialization Certification Examination at Indiana Continuing Legal Education Forum's 2008 Estate Planning and Administration Specialization training conference in September 2008.

Jennifer Hawkins Teaches Will & Trust Law Wednesday, April 16 2008
The Indiana Continuing Legal Education Forum (ICLEF)tapped Jennifer Hawkins again for its 2008 Fundamentals of Will and Trust Drafting conference faculty. The conference was held at the ICLEF facility in Indianapolis on February 27, 2008. ICLEF is the premier continuing legal education provider for Indiana lawyers. Ms. Hawkins' contribution to the program featured analysis of the need for a will or trust in estate planning and certain pitfalls that attorneys should avoid to protect their clients.

Jeff Hawkins joined the faculty of the second annual Estate Planning and Administration Specialization conference hosted by the Indiana Continuing Legal Education Forum on November 2, 2007, in Indianapolis. Jeff presented material on guardianship law to the estate planning and administration specialty certification applicants.

Hawkins debates Supreme Court rules Friday, June 1 2007
The Indiana State Bar Association's Professional Legal Education, Admission and Development Section have engaged Jeff Hawkins and Jeff Nickloy to debate proposed Indiana Supreme Court rules on lawyer advertising at the 2007 GP Solo and Small Firm Conference in Indianapolis. The proposed rules are published on the Indiana Supreme Court website at http://www.in.gov/judiciary/rules/proposed/2007/january.html. Jeff Nickloy chaired the Indiana State Bar Association committee that proposed the new rules. Jeff Hawkins' position challenges whether the proposed rules address adequately the way prospective clients acquire legal service information nowadays.

Estate Planning & Administration Specialty Certification for Jeff Hawkins Friday, June 1 2007
Jeff Hawkins was certified as an Estate Planning & Aministration Specialist this spring by the Indiana State Bar Association's Estate Planning & Administration Specialty Certification Board (EPASCB). EPASCB certifies specialists upon qualification through a combination of written examination; peer references; experience; and extensive, advanced level classroom instruction.

Governor Daniels signs legislation written by Jeff Hawkins Friday, June 1 2007
Governor Mitch Daniels signed House Enrolled Act 1508 into law last month. Jeff Hawkins wrote sections 1, 17 and 19 of the law concerning matters that affect Indiana estates and trusts. Section 1 removes barriers that previously denied certain property tax exemptions for people who set up trusts in their estate plans. Section 17 preserves privacy for people that set up trusts by eliminating the requirement that their Social Security numbers be listed in trust certificates. Section 19 creates an entirely new article of the Indiana Code to require title insurance companies to insure land that people transfer to their trusts for estate plan purposes.

Jeff Hawkins has been invited join the 2007 Legal Education Conclave on June 8 & 9. The Conclave is a gathering of lawyers, judges and law school faculty that consider how new lawyers can be prepared better for law practice in a rapidly changing legal environment. The Conclave chairpersons are Lauren K. Robel, Dean of the Indiana University School of Law, and Susanah M. Mead, Interim Dean of the Indiana University School of Law - Indianapolis.

ICLEF adds Jennifer Hawkins to its faculty Tuesday, February 20 2007
The Indiana Continuing Legal Education Forum engaged Jennifer Hawkins in its instructor faculty for its Fundamentals of Will and Trust Drafting conference on February 16, 2007. Jennifer presented her paper entitled: "THE CASE FOR WILLS AND TRUSTS: WHO NEEDS THEM AND WHEN."

Indiana State Bar Association elects Jeff Hawkins to Board of Governors Monday, October 23 2006
The Indiana State Bar Association elected Jeff Hawkins to the District 7 Governor position on the ISBA's Board of Governors at the ISBA's House of Delegates Assembly luncheon on October 6, 2006. Hawkins serves a two year term as a member of the ISBA's governing board and represents attorneys in an area that includes Sullivan, Greene, Monroe, Vigo, Clay, Owen, Vermillion, Parke, Putnam, Morgan, and Hendricks Counties.

Indiana State Bar Association's Probate, Trust and Real Property Section Elects Jeff Hawkins Monday, October 23 2006
The Indiana State Bar Association's Probate, Trust and Real Property Section elected Jeff Hawkins Secretary at its annual meeting on October 6, 2006. Hawkins has previously served the section as a co-chair of its specialization committee, which designed the Section's new Estate Planning and Administration Specialization certification system for implementation in November 2006.

Congress Deals a Blow to Hoosier Landowners Monday, February 20 2006
Congress has enacted the long dreaded Deficit Reduction Act of 2005. We can expect now that the new law will force many family farmers to sell farmland to pay for long-term care.

Here is one of the many ridiculous results that the new law may cause:

Imagine that a grandma gives her granddaughter some money to help repair the granddaughter's car. Then, the grandma suffers a stroke and must be cared for in the nursing home. After insurance runs out, the grandma will spend her remaining wealth to pay for her own care. After the money runs out, Medicaid will deny the grandmother eligibility for several months because the grandmother gave some money to her granddaughter, leaving the grandmother no means to pay for her care.

We are exploring new ways to help families avoid these terrible crises. Consult with a knowledgeable elder law attorney before giving money and other gifts because Congress has prepared the way to punish such kindness mercilessly.

New Trust Legislation Progressing In Indiana Monday, January 2 2006
Jeff Hawkins proposed new legislation in 2005 to protect property tax exemptions for disabled veterans and other Hoosier property taxpayers. The proposed legislation may be found at: http://www.in.gov/legislative/bills/2006/IN/IN0115.1.html.

Presently, a deed of real estate to a trust can terminate certain property tax deductions. The proposed legislation will preserve property tax deductions for all individual Hoosiers.

Hawkins Teaches Legal Ethics Tuesday, November 29 2005
Jeff Hawkins presented the new Indiana Rules of Professional Responsibility and a summary of reported cases regarding legal ethics to a group of Sullivan County attorneys on November 17, 2005. The Wabash Valley Community Foundation sponsored the event at the Sullivan Elks Country Club to help the attorneys fulfill their continuing legal education requirements and share with the attorneys how estate planning clients can stretch their wealth to improve the community through charitable endowments.

New Indiana Laws Wreck Estates Tuesday, May 17 2005
The Indiana General Assembly overhauled Medicaid laws this spring and disrupted several well-established rules regarding the administration of guardianships and decedents' estates. Basic assumptions about passing wealth to your children are probably void now. For example, if a man enters a nursing home and his wife plans to keep her half of the assets, Medicaid can invade her estate when she dies and recover her assets to pay his nursing home bills after his assets are depleted. Now, more than ever, estate planning requires a detailed familiarity with the minefield that these terrible new laws have created.
